Towards the end of last year, around October or November, my friend in Bintulu bought a new car – one of those popular Japanese brands, not our own Malaysian-made ones. The other day, I had the shock of my life when he sent me some photographs via mms…
He said he had just come from around the bend along that road, so he was not driving very fast…and suddenly, his tyre “patah” (broke). I did not know what he meant by that, so I asked him whether his axle broke but he did not reply.
He just said that his car turned two times. Again, I was puzzled as to what exactly he was trying to tell me – whether it spun round and round or whether it rolled over…
…but judging from the photographs, it probably somersaulted with him inside…
…and luckily, he managed to escape unscathed. Since the accident, he has not had a car to use. It seems that the vehicle has to undergo some major repairs. I asked him why he did not demand for a brand new car since this one was still under warranty and told him that he should sue them if they refused. He just sent me a sad-faced smiley!
Well, with all the festivities in the next few days, remember NOT to drink and drive and do be careful when you are on the road! Drive safely!

I would definitely demand for a new car considering this one is less than a year or two. Maybe you can help him write a strong demanding letter to the manufacturer. LOL

If I were him, I’ll make helluva noises and get the company to give me a replacement! (Get a law-eya or something) Write letter, e-mail to all the relevant parties, summore with pictures ler, even better. If all else failed, go to the press (Neh, that Michael Chong or consumer association). That would do the trick, most of the time.

Summore with all the publicity, I am sure the manufacturer most probably will replace the car to save face. Obviously the faulty car is a defect. It’s a car ler, it can protect you or kill you, why don’t want to go through all the hassle? He paid so much for it summore, not that he can just chuck it away like that unless he’s filthy rich then I have nothing to say lar.
Not rich lah!…I heard of one guy who bought a car – also Japanese but not the same company and the same thing happened. The wheel axle broke! He got a lawyer to demand for ALL his money back. The company offered him a brand new one…but he simply refused. Dunno how his case ended in the end…
Heard now the assembly plant is located at Thailand for that brand. The quality of the car and material used are not as good as last time. Maybe your friend can write to the manufacturer and demand an investigation of the failure of the tyre. Then if it is their manufacturing problem, can proceed to claim warranty and progressive damage of the car from the manufacturer. But as for the manufacturer, they will not replace a brand new car for your friend for sure but a repaired one on their cost if it is a failure caused by manufacturing defects. Glad that your friend is ok. At least the airbag works.
Ya…I heard they’re assembled in Thailand and some people actually believe that it is better than being assembled in Malaysia. I don’t know why they feel that way but as far as I am concerned, where cheap labour is concerned…you can expect the worst! I think that is what the company is doing now…and they are taking a long time even in trying to find a car for him to use in the meantime. Has been going without a car since the accident. Ya, thank God for small mercies. That’s most important in any accident – as long as the people involved are all right!

I’ve seen cars along the road that had suffered a similar fate but usually they were quite old and did not look as if they had been properly maintained, but this one is brand new!
By right, he should be claiming for a new one.

And cheated! I’m not going to mention brand names…but in the case of my car, before the warranty was up, the nice people at the service centre who serviced my car would just break and spoil whatever part and replace with brand new ones…especially those that they had seen becoming problematic in other cars! I did not even have to ask them to do that!

I dunno…but in the case of the other guy my Dad knew…with another Japanese car, not this one, he had to sue…to demand for all his money back and only then did they make a counter offer – to replace it with a new car, but he flatly refused…and insisted on a total refund. Dunno what happened after that though…
